Texas Marriage License Guide
Texas marriage license
The essentials, without the legal fog.
From Elope Us
There are moments in wedding planning that feel exciting.
Finding the perfect place. Writing your vows. Imagining the day you’ll finally say, “I do.”
And then there are the practical moments.
Scheduling appointments. Signing paperwork. Getting your marriage license.
It may not be the most romantic part of your wedding journey, but it’s the one that makes everything official.
The good news?
Texas makes the process surprisingly straightforward.
We’ll walk you through everything you need to know, so you can spend less time worrying about the paperwork and more time looking forward to your wedding day.
Do You Need a Texas Marriage License?
Yes.
If you’re getting legally married in Texas - including an elopement - you’ll need a valid Texas marriage license before your ceremony.
The good news is that a marriage license issued by any Texas county can be used anywhere in Texas.
So whether you’re exchanging vows in downtown Austin, the Hill Country, or a quiet lakeside park, you don’t have to obtain your license in the same county where you’ll be getting married.
That flexibility makes planning much easier, especially for couples traveling to Austin from elsewhere in Texas or out of state.
Where Do You Get a Marriage License?
You’ll visit any Texas county clerk’s office.
If you’re planning an Austin elopement, many couples choose one of the nearby county offices, but any county in Texas can issue a license that’s valid statewide.
Before you go, it’s always a good idea to check the county’s website for current office hours, appointment requirements, accepted payment methods, and any updates to the application process.
What You’ll Need
While requirements can vary slightly, most couples should plan to bring:
A valid government-issued photo ID for each person
Payment for the marriage license fee
Any additional documentation required by the county, if applicable
If you apply in Travis County and neither applicant can provide acceptable proof of Texas residency, an additional $100 nonresident fee applies. Confirm current fees and requirements with the county clerk before applying.
Review the Travis County Clerk’s marriage license instructions for current application, timing and return requirements.
Is There a Waiting Period?
For most couples, yes.
Texas generally has a 72-hour waiting period between the time your marriage license is issued and when your ceremony can legally take place.
There are a few exceptions under Texas law, but most couples should simply plan ahead and obtain their license a few days before their wedding.
If you’re traveling to Austin for your elopement, we recommend building this into your timeline so you can relax and enjoy your wedding week.
How Long Is a Texas Marriage License Valid?
Your ceremony must take place before the 90th day after your license is issued. A license that has not been used before that day expires.
That gives most couples plenty of flexibility when planning their ceremony.
If your wedding date changes beyond that window, you’ll simply need to obtain a new license.
Do You Need Witnesses?
One of the questions we hear most often is:
“If we’re eloping, do we need witnesses?”
The answer is simple:
No.
Texas does not require witnesses for a legal marriage ceremony.
You’ll need an authorized officiant to perform the ceremony, but witnesses aren’t required under Texas law.
For many couples choosing an intimate wedding, that’s one less detail to worry about.
After the Ceremony
Once your ceremony is complete, your officiant will complete the required paperwork and return your signed marriage license according to Texas requirements.
After it’s processed, you’ll be able to request certified copies if you need them for changing your name, updating identification, or other legal documents.
Planning from Out of State?
You’re not alone.
Austin has become one of the country’s favorite destinations for intimate weddings and elopements.
If you’re traveling from another state, plan your elopement timeline with time to obtain your license before the ceremony.
That gives you time to obtain your marriage license, settle into your accommodations, and enjoy Austin before your wedding day arrives.
One of the unexpected joys of an elopement is that it can feel like both a wedding and a getaway.
Take advantage of that time together.

From Elope Us
The paperwork is important.
But don’t let it become the focus.
One day, you’ll remember standing together during your ceremony.
The way you smiled.
The promises you made.
The feeling of beginning a new chapter together.
You probably won’t remember the county clerk’s office. And that’s exactly as it should be.
We’ll help make sure the paperwork is taken care of, so you can focus on everything that truly matters.
With love,
